      <title>Why write (or not) a constitution in the 21st Century?</title>

      <description>Cet article interroge la pertinence de la rédaction d’une constitution au xxie siècle en mettant en lumière la diversité des contextes dans lesquels une telle démarche peut s’inscrire. L’auteur montre que la décision d’écrire une constitution ne saurait être appréhendée à travers une grille universelle, mais doit être analysée à l’aune des réalités historiques, politiques et sociales propres à chaque État. Au-delà de sa fonction normative, la constitution apparaît comme un instrument de transition, de légitimation et de refondation du contrat social, notamment en période de crise, de sortie de conflit ou de transformation démocratique. Le texte insiste également sur les conditions de faisabilité et de succès du processus constituant, telles que le temps, la participation, l’ouverture, la légitimité institutionnelle et les modalités de mise en œuvre. Il conclut que la question fondamentale n’est pas seulement celle de l’opportunité d’écrire une constitution, mais surtout celle des finalités poursuivies par ce choix. This paper examines the relevance of constitution-making in the twenty-first century by highlighting the diversity of contexts in which such a process may arise. The author argues that the decision to draft a constitution cannot be approached through a universal framework, but must instead be assessed in light of the historical, political, and social realities specific to each state. Beyond its normative function, the constitution is presented as an instrument of transition, legitimisation, and redefinition of the social contract, particularly in times of crisis, post-conflict settlement, or democratic transformation. The text also emphasises the conditions necessary for the feasibility and success of constitution-making, including time, participation, openness, institutional legitimacy, and implementation mechanisms. It concludes that the central issue is not merely whether a constitution should be written, but rather the objectives and transformations such a process is intended to achieve. </description>

      <title>Le recours au référendum dans un processus constituant : quand, pourquoi et comment ?</title>

      <description>Ces dernières décennies, le recours au référendum dans un processus constituant est de plus en plus fréquent. Jusqu’à une époque récente, le taux de succès de tels référendums était très élevé. Toutefois, au regard des échecs enregistrés ces dernières années, une tendance croissante à remettre en cause la pertinence de recourir à un référendum se dessine. Cette étude présente les cas dans lesquels un référendum est prévu, de manière obligatoire ou facultative, dans un processus constituant originaire ou de révision de la constitution. Elle s’interroge sur l’opportunité d’un recours au référendum dans le cadre d’une réforme constitutionnelle. Elle insiste, enfin, sur les conditions nécessaires pour assurer la sincérité du scrutin dans un État démocratique. In recent decades, the use of referendums in constitutional processes has become increasingly common. Until recently, the success rate of such referendums was very high. However, in light of the failures recorded in recent years, there is a growing tendency to question the suitability of resorting to a referendum. This study presents cases in which a referendum is provided for, either as a mandatory or optional measure, in an original constitutional process or in the revision of a constitution. It examines the appropriateness of using referendums in the context of constitutional reform. Finally, it emphasises the conditions necessary to ensure the integrity of the vote in a democratic state. </description>

      <title>Le consensus dans le nouveau constitutionnalisme des États d’Afrique subsaharienne francophone</title>

      <description>L’un des marqueurs du renouveau constitutionnel africain est sans aucun doute, la priorisation affichée du consensus dans la production constitutionnelle et dans l’exercice du pouvoir. Dès le début des années 1990, l’on a inauguré la procédure constituante inclusive marquée par le passage de l’écriture unilatérale à l’écriture multilatérale des textes constitutionnels. C’est aussi à partir de ce moment que l’ingénierie constitutionnelle a commencé à envisager de nombreuses situations dans lesquelles, le consensus entre gouvernants et gouvernés ou entre pouvoirs institués est indispensable. La volonté d’enracinement de la démocratie et de pacification de l’État est ainsi palpable. Seulement, à l’épreuve des faits, il y a comme une altération du consensus qui sous-tend à plusieurs égards, l’instabilité de la plupart des États visés par cette étude. One of the hallmarks of Africa’s constitutional renewal is undoubtedly the prioritization of consensus in the production of constitutions and the exercise of power. In the early 1990s, the inclusive constituent procedure was inaugurated, marked by a shift from unilateral to multilateral drafting of constitutional texts. It was also at this point that the content of constitutions began to take into account the many situations in which consensus between rulers and governed, or between instituted powers, is essential. The will to entrench democracy and pacify the State is thus palpable. However, when the facts are put to the test, there is a kind of trivialization of consensus which, in many respects, underlies the instability of most of the states covered by this study. </description>

      <title>La réflexivité au cœur du droit constitutionnel comparé</title>

      <description>Réfléchir à l’émergence du concept de « culture de constitution » dans le débat académique pose la question de l’intériorisation par les acteurs politiques et juridiques des formes constitutionnelles dans leurs pratiques politiques. Inscrit dans une démarche comparatiste, ce phénomène permet de mettre en évidence des trajectoires nationales singulières, déterminées par l’histoire, les mœurs, les contextes sociaux et les règles de droit. Ce concept devient ainsi un étalon pour éprouver la légitimité et l’adhésion ressenties à l’égard de la Constitution. Une telle méthode juridico-culturelle nous informe plus largement sur la fonction réflexive du droit constitutionnel comparé : « connaître l’autre pour mieux se connaître soi-même ». Reflecting on the emergence of the concept of « culture of constitution » in the academic debate asks about the internalization by political and legal actors of constitutional forms in their political practices. In other words « respect the constitution », what does it mean? Part of a comparative approach, this phenomenon makes it possible to highlight singular national trajectories determined by history, mindsets, social contexts and law. So, this concept becomes a yardstick to test the legitimacy and approval towards the Constitution.       <title>La crise sanitaire : aspects juridiques franco-brésiliens</title>

      <description>La comparaison entre la France et le Brésil dans le traitement juridique de la crise sanitaire révèle des tendances communes, particulièrement sur le plan matériel. En revanche, des divergences apparaissent sur le plan institutionnel, lesquelles s’expliquent par la structure organisationnelle propre à chaque pays, mais également par leur contexte politique. Alors qu’en France une tendance à la centralisation du pouvoir a pu être observée, au Brésil les insuffisances du pouvoir central ont conduit à revaloriser le rôle des acteurs locaux et à donner toute sa force à la fonction de contre-pouvoir endossée par le pouvoir judiciaire. La crise sanitaire a ainsi fait émerger de nouveaux rapports de force institutionnels, ravivant des enjeux de légitimité. Comparing the legal handling of the health crisis in France and Brazil reveals common trends, particularly in terms of substantive law. But on the other hand, the comparison shows differences regarding institutional law, which can be explained by the organizational structure of each country, but also by their political context. Whereas in France there has been a tendency to centralize power, in Brazil, the inadequacies of central government have led to a revaluation of the role of local authorities, and to give the full force of the counter-power function of the judiciary. The health crisis has therefore given rise to new institutional power relations, which has revived issues of legitimacy. </description>
