      <title>Drafting a Constitution in the 21st Century – Lessons from Chile</title>

      <description>This article examines the Chilean constitution-making process (2019–2023) as a key case study for understanding contemporary constituent power. Following the 2019 social uprising, Chile launched an ambitious and highly participatory effort to replace the Constitution inherited from the Pinochet era. Despite innovative mechanisms of citizen participation and institutional deliberation, the two successive draft constitutions adopted in 2022 and 2023 were both rejected by referendum. Rather than treating this outcome solely as a failure, the article analyzes the Chilean case as a laboratory for contemporary constitutional theory and comparative constitutional law. It highlights the tensions between democratic legitimacy, popular participation, procedural innovation, and the search for durable constitutional compromise in pluralistic societies. The Chilean experience is thus approached less as a model to be replicated than as a critical analytical framework for reflecting on constitution-making in the 21st century. Cet article analyse le processus constituant chilien (2019–2023) comme un cas d’étude majeur pour comprendre les transformations contemporaines du pouvoir constituant. À la suite du soulèvement social de 2019, le Chili a engagé une démarche ambitieuse et fortement participative visant à remplacer la Constitution héritée de l’ère Pinochet. Malgré des mécanismes innovants de participation citoyenne et de délibération institutionnelle, les deux projets constitutionnels successifs adoptés en 2022 et 2023 ont été rejetés par référendum. Plutôt que d’appréhender ce résultat uniquement comme un échec, l’article examine le cas chilien comme un laboratoire pour la théorie constitutionnelle contemporaine et le droit constitutionnel comparé. Il met en lumière les tensions entre légitimité démocratique, participation populaire, innovation procédurale et recherche d’un compromis constitutionnel durable dans les sociétés pluralistes. L’expérience chilienne apparaît ainsi moins comme un modèle à reproduire que comme un cadre analytique critique pour penser l’écriture constitutionnelle au xxie siècle. </description>

      <title>Les droits et libertés du numérique. Étude comparée en droits français et américain : éléments de méthode d’une thèse de droit comparé</title>

      <description>Cet article propose de retracer la méthodologie comparative utilisée dans le cadre du travail de thèse sur les droits et libertés du numérique comme droits fondamentaux en voie d’élaboration. Il s’agit de justifier l’opportunité du recours à la méthode comparative, de préciser les enjeux de la comparaison ainsi que ses apports. Tout d’abord, l’article met en lumière l’intérêt d’une recherche comparative s’agissant des droits et libertés du numérique. Bien que l’analyse du degré d’autonomie de ces droits eût été concevable dans l’ordre juridique français exclusivement, une telle recherche n’aurait présenté qu’un intérêt limité dans la mesure où l’objet de la recherche se rapporte au numérique qui a une dimension ubiquitaire. Ensuite, l’article fait état de la méthode et des enjeux de la comparaison. La comparaison voit ses modalités déterminées par les enjeux de la recherche qui consistent à démontrer l’autonomisation progressive des droits et libertés du numérique en France et aux États-Unis. Enfin sont présentés les apports de la comparaison. Cette dernière a notamment contribué à la réflexion sur la systématisation des droits et libertés du numérique en une nouvelle catégorie de droits fondamentaux. This article describes the comparative methodology used as part of a thesis on digital rights and freedoms as fundamental rights in the making. The aim is to justify the appropriateness of using the comparative method, and to explain what is at stake and what it can bring to the discussion. First of all, the article highlights the value of comparative research into digital rights and freedoms. An analysis of the degree of autonomy of these rights would have been conceivable exclusively in the French legal system. However, such a research work would have been of limited interest, insofar as the object of the research relates to digital ubiquitous dimension. The article goes on to describe the method and the challenges of this comparison effort. The modalities of the comparison are determined by the research challenges which demonstrate the progressive empowerment of digital rights and freedoms in both France and the United States. Finally, the contributions of the comparison are highlighted. In particular, it has contributed to the debate on the systematization of digital rights and freedoms into a new category of fundamental rights. </description>
