Dans un second temps, la contribution vise, à partir de la thèse de doctorat nous avons soutenue, portant sur le conflit opposant la Catalogne à l’Espagne, à apporter une illustration de l’un des intérêts que peut représenter une thèse en droit étranger pour le droit constitutionnel, à savoir mettre en perspective des concepts fondamentaux de la théorie constitutionnelle, en l’espèce le fédéralisme et le droit de sécession. Firstly, this contribution seeks to highlight the specific nature of the study of foreign law, which must be clearly distinguished from research into comparative law, given the distinct scientific approach and objectives of each of these two types of approach. Elle insiste d’abord sur l’importance du travail préparatoire à la comparaison, notamment sur la nécessité de ne pas biaiser les objets d’études par leur multiplication ou par le choix de paramètres de comparaison inadaptés. L’article montre ensuite l’utilité de fléchir la méthodologie à chaque cas d’étude à partir d’un cadre inspiré par la linguistique structuraliste et générative. C’est ainsi que la comparaison permet un recul heuristique qui enrichit la connaissance des objets comparés, des systèmes auxquels ils appartiennent et des cas s’en rapprochant par analogie. This contribution aims to outline the principles of a comparative method in constitutional law in the light of the doctoral dissertation entitled Federalism Without the Federal State – The Question of the Unity of Spain and the United Kingdom (Mare & Martin, 2023). It first highlights the importance of preparatory work for comparison, in particular the need to avoid biasing the objects of study by multiplying them or by choosing inappropriate comparison parameters. The paper then shows how useful it is to adapt the methodology to each case of study, using a framework inspired by structuralist and generative linguistics.
