En droit belge, l’intégration des biens du domaine privé des personnes publiques dans le circuit économique suscite peu de difficultés. Il n’en va pas de même des biens de leur domaine public. Assujettis à un régime contraignant, ils sont a priori réfractaires à toute occupation privative. La jurisprudence, épaulée par la doctrine et tout récemment par le législateur, a relativisé cette incompatibilité de façade. Quels sont les instruments juridiques mobilisables ? À quelles conditions ? Ces outils répondent-ils aux attentes des acteurs économiques ? Ces questions sont au cœur de notre contribution, qui étudie les possibilités de valoriser le domaine public par l’octroi de droits d’usage à des personnes privées. In Belgium as elsewhere, public authorities seek to make their assets profitable. Belgian law faces no hindrances to integrate the private domain belonging to public authorities into the economic circuit. However, the same cannot be said of goods in the public domain. Bound to a restrictive regime, they are at first sight reluctant to an exclusive occupancy. Jurisprudence, doctrine and, more recently, legislation have put the scope of this incompatibility into perspective. Public authorities arrange from now on several legal tools allowing them to value their public domain. What tools are available? Under what conditions are they allowed? Do these possibilities meet the expectations of economic actors?
