Des réglementations en la matière ne sont intervenues que récemment. Alors que la sociologie du conflit montre un penchant traditionnel pour la juridictionnalisation de ce dernier, cet article discute le lent changement culturel, dans la société colombienne, tendant à l’utilisation d’autres moyens de résolution du « contentieux ». Aussi l’auteur propose-t-il de différencier les concepts de litige et de conflit, le dernier étant davantage propice à la médiation. Administrative mediation is provided for in Colombian law to resolve conflicts between citizens and the administration, as well as conflicts between public authorities and even between individuals, but it is not a sufficiently well-known mechanism, not only by the specialized doctrine, but also by citizens. Regulations in this area have only recently taken place. While the sociology of conflict shows a traditional leaning for the judge, this article shows how a slow cultural change is taking place in Colombian society towards the use of other means of dispute resolution.
