Dès le début des années 1990, l’on a inauguré la procédure constituante inclusive marquée par le passage de l’écriture unilatérale à l’écriture multilatérale des textes constitutionnels. C’est aussi à partir de ce moment que l’ingénierie constitutionnelle a commencé à envisager de nombreuses situations dans lesquelles, le consensus entre gouvernants et gouvernés ou entre pouvoirs institués est indispensable. La volonté d’enracinement de la démocratie et de pacification de l’État est ainsi palpable. Seulement, à l’épreuve des faits, il y a comme une altération du consensus qui sous-tend à plusieurs égards, l’instabilité de la plupart des États visés par cette étude. One of the hallmarks of Africa’s constitutional renewal is undoubtedly the prioritization of consensus in the production of constitutions and the exercise of power. In the early 1990s, the inclusive constituent procedure was inaugurated, marked by a shift from unilateral to multilateral drafting of constitutional texts. It was also at this point that the content of constitutions began to take into account the many situations in which consensus between rulers and governed, or between instituted powers, is essential. The will to entrench democracy and pacify the State is thus palpable.
