Il est ici proposé de sortir de cette confrontation par le droit, en passant par la conciliation de la théorie des statuts, aboutissement de la théorie des droits publics subjectifs chez Jellinek. En repensant le citoyen comme sujet de droit en même temps qu’organe de l’État, et en renforçant la réciprocité de reconnaissance État-citoyens, la participation peut s’intégrer à la délibération législative sans diminuer la légitimité parlementaire, à la condition d’institutionnaliser un espace public structuré et propice au compromis. Historically at opposition, representative democracy and more participatory democracy appear incompatible within a parliamentary system: citizen participation is seen as intrinsically undermining the legitimacy of Parliament. This paper proposes a way out of this conflict using the theory of status, the culmination of Jellinek’s theory of subjective public rights.
